1. About Us & Acceptance of Terms

NVZ Beanies is a small-scale, independent South African brand specializing in handmade cotton baby beanies. By accessing our website, purchasing products, or engaging with our services, you confirm that you are at least 18 years old (or have parental/guardian consent) and agree to be bound by these Terms and Conditions.

2. Products and Handmade Nature

  • Each NVZ Beanie is handcrafted with care. Because our items are handmade, slight variations in sizing, stitching, or appearance may occur, making each piece uniquely yours.
  • Product descriptions and images are displayed as accurately as possible, though colors may vary slightly depending on your screen settings.

3. Strict No-Reselling Policy

  • Personal Use Only: All products purchased from NVZ Beanies are intended solely for personal use or as gifts and may not be resold, redistributed, or commercialized under any circumstances.
  • Prohibition of Commercial Resale: Customers, third-party retailers, or unauthorized entities are strictly prohibited from buying our beanies to resell them for profit on other platforms, social media, or retail channels.
  • Legal Action: Any unauthorized commercial reselling, imitation of our brand identity, or misuse of NVZ Beanies products constitutes a violation of our intellectual property and commercial rights. NVZ Beanies reserves the right to take legal action against any individual or entity attempting to commercially resell our products without explicit written permission.

4. User Conduct and Account Rules

  • When creating an account or interacting with our website, you agree to provide accurate information and use our platform lawfully.
  • Prohibited Behavior: Users are strictly prohibited from posting abusive, threatening, or inappropriate content, attempting to hack or compromise the website security, or engaging in fraudulent activity.
  • Account Termination: NVZ Beanies reserves the right to suspend or terminate any user account immediately and without notice if a user engages in inappropriate conduct, violates our policies, or breaches these terms.

5. Pricing and Payments

  • All prices listed on our website are in South African Rand (ZAR).
  • We accept secure online payments via PayFast (credit/debit cards, instant EFT, etc.) as well as Direct Bank Transfers (EFT).
  • For Direct Bank Transfers, orders will only be processed and dispatched once the funds reflect securely in our account. If proof of payment is not provided within 48 hours, the order may be cancelled.

6. Shipping and Delivery

  • We ship our products domestically within South Africa using The Courier Guy.
  • Shipping costs and estimated delivery timeframes are calculated at checkout based on your delivery address.
  • We ship our products domestically within South Africa using reliable third-party courier services. While we make every effort to ensure your order is dispatched swiftly, delivery timelines are estimates provided by the courier service and may be subject to delays beyond our reasonable control. Risk of damage or loss to the products passes to you only upon physical delivery of the package to the address provided at checkout. In the event of transit issues or courier mishandling, we will actively assist you in tracking and resolving the matter.


7. Returns, Exchanges, and Refunds

  • 7-Day Cooling-Off Period (ECTA): In terms of the Electronic Communications and Transactions Act, you have the right to cancel your purchase and return your item for any reason within 7 days of receiving it. To qualify for a change-of-mind return, items must be entirely unworn, unwashed, and in their original packaging. The customer is responsible for the courier costs of returning the item safely to us.
  • 6-Month Statutory Warranty (CPA): In accordance with the Consumer Protection Act, all items carry an implied 6-month warranty against manufacturing defects or material faults. If your item develops a genuine defect or falls apart due to poor manufacturing within 6 months, please notify us via email immediately with photographic evidence. You will be entitled to a repair, a replacement, or a full refund.
  • Hygiene Exceptions: Due to health, hygiene, and the delicate nature of handmade baby garments, change-of-mind returns cannot be accepted for items that have been worn or washed.

8. Limitation of Liability

  • To the maximum extent permitted by South African law, NVZ Beanies shall not be held liable for any indirect, incidental, special, or consequential damages arising out of or connected to the use of our website, products, or services.
  • If our products or services cause unexpected delays, temporary platform outages, or delivery issues beyond our reasonable control (including force majeure events, courier disruptions, or technical glitches), our liability is strictly limited to the purchase price of the specific product paid by the customer.

  • NVZ Beanies reserves the right to update, modify, or change these Terms and Conditions at any time without prior notice.
  • Any changes will be posted directly on this page with an updated “Last Updated” date. Your continued use of the website following any changes constitutes your formal acceptance of the new terms.

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the South African courts.
